Terms of Use
By using the content or classes in the Operation Human First (“OHF”) platform or purchasing any Operation Human First product, you acknowledge that you have read, understood, and agree to be bound by the following Terms of Use.
1. DEFINITIONS
“Instructor” means Alexandria Murphy, founder and creator of Operation Human First.
“Content” means all materials made available through the Operation Human First platform or related digital channels, including but not limited to videos, classes, courses, Engrams, downloadable PDFs, e-books, recipes, webinars, emails, graphics, text, images, and any accompanying resources or materials (collectively, “Products”).
“User,” “You,” or “Your” refers to any individual accessing or purchasing the Content.
The Content is provided for educational and informational purposes only. It does not constitute medical, psychological, nutritional, financial, career, or therapeutic advice.
2. ACCEPTANCE OF TERMS
By accessing or using the Content, the User agrees to comply with these Terms of Use.
The Instructor may amend these Terms at any time in her sole discretion. Notice of any material amendments will be posted or communicated to Users. Continued use of the Content constitutes acceptance of all amended Terms.
3. NATURE OF SERVICES
Operation Human First provides educational resources designed to support general mobility, stress regulation, lifestyle optimization, and self-directed health education.
The Content may include references to exercise (including but not limited to Kinstretch), neuroscience, physiology, nutrition, supplementation, and behavioral strategies for general well-being.
The User acknowledges that the exercises within the Content, including but not limited to Kinstretch, are types of physical activity designed to improve general mobility and movement capacity. The exercises within the Content are not a form of physical therapy. All services provided by the Instructor in relation to the Content are not physical therapy and do not fall within the jurisdiction of the Saskatchewan College of Physical Therapists, nor is the Content regulated by any similar body or medical body in any other jurisdiction.
4. MEDICAL & PSYCHOLOGICAL DISCLAIMER
The Content is not intended to diagnose, treat, cure, or prevent any disease, condition, or psychological disorder.
The User must consult with a licensed physician or qualified healthcare provider before beginning any exercise, nutrition, or supplement regimen, particularly if you have a medical or mental-health condition, injury, or are pregnant or breastfeeding.
Never disregard professional medical advice or delay seeking it because of something presented in the Content.
Use of the Content is entirely at the User's own risk.
5. SUPPLEMENT & NUTRITION DISCLAIMER
Any mention of food, supplements, nutraceuticals, or dietary strategies is for general informational purposes only.
The Instructor does not sell or endorse specific brands and does not guarantee the safety, efficacy, or legality of any product.
Users are solely responsible for verifying individual tolerance, allergies, contraindications, and compliance with applicable laws before using any product or implementing any dietary or supplement change.
6. FINANCIAL, BUSINESS, & CAREER DISCLAIMER
Certain Operation Human First products may discuss topics such as personal finance, investing, business strategy, entrepreneurship, or professional development. All such information is provided for general educational and informational purposes only and does not constitute financial, accounting, tax, legal, or career advice.
The Instructor is not a licensed financial advisor, accountant, investment professional, or career consultant, and no part of the Content should be interpreted as personalized advice or a solicitation to buy, sell, or invest in any financial instrument or business. Any actions taken based on the Content are undertaken entirely at the User’s own risk. Users should seek independent professional advice before making financial or career decisions.
7. HEALTH AND SAFETY
The User must, prior to accessing and using the Content, consult with a physician and confirm that the User is healthy, in good physical condition and free from any disability or condition that could be adversely impacted by using the Content and engaging in the activities demonstrated in the Content, which may include rigorous physical activity, resistance training, body weight calisthenics, cardiovascular training, jumping, running and stretching.
The User must immediately stop using the Content and contact a physician if it experience any adverse medical condition or reaction to the activities demonstrated in the Content, including light-headedness, dizziness, fatigue, shortness of breath, rapid or weak heartrate, pain in the chest, head or abdomen, blurred vision, joint pain, or any condition or symptom not typically experienced during physical activity.
Risks of Use
The User acknowledges that:
a) the Content includes intense physical activities and dynamic movements; and
b) engaging in the activities demonstrated in the Content poses a significant risk of injury, including but not limited to heart attack, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, back, foot, or other serious ailments including death.
The User assumes all risks inherent with the activities depicted in the Content and expressly waives and releases the Instructor, its agents, partners, subsidiaries and assigns, from any claim, liability, damage or expense arising from the User’s use, engagement or involvement with the Content and the performance of any activities depicted or recommended in the Content.
8. RISKS AND WAIVER OF LIABILITY
By using the Content, the User understands and accepts that:
The activities demonstrated may include intense physical exertion and dynamic movement.
Injuries may occur, including but not limited to strains, sprains, fractures, cardiovascular incidents, or other serious ailments.
The User voluntarily assumes all risks associated with use of the Content and hereby release, waive, and discharge the Instructor, her agents, employees, affiliates, successors, and assigns from any and all claims, liabilities, damages, or expenses arising from or related to the User's use of the Content.
9. NO PROFESSIONAL RELATIONSHIP
Use of the Content does not establish a clinician-patient, therapist-client, or fiduciary relationship between the User and the Instructor.
No personalized diagnosis, medical assessment, or treatment plan is provided through the Content.
10. PERSONAL EXPERIENCE DISCLOSURE
Any testimonials, stories, or examples provided by the Instructor represent individual experiences and are not guarantees of results.
Outcomes vary depending on personal factors such as health history, genetics, environment, and effort.
11. INTELLECTUAL PROPERTY RIGHTS
All right, title, and interest in the Operation Human First brand, platform, and Content remain the exclusive property of the Instructor and are protected under copyright, trademark, and other intellectual-property laws.
The User may access and use the Content for personal, non-commercial, educational purposes only.
Without prior written consent, the User shall not:
Copy, distribute, or publicly display the Content;
Reproduce or share it within any paid or unpaid program, service, or group;
Reverse engineer, convert, or create derivative works; or
Use the Content for teaching, coaching, or consulting purposes.
Violation of these terms may result in immediate termination of access and legal action.
12. DISCLAIMER OF WARRANTIES
The Content is provided “as is” and “as available.”
The Instructor makes no representations or warranties—express or implied—regarding accuracy, completeness, suitability, non-infringement, or fitness for a particular purpose.
The Instructor does not warrant that:
Access will be secure, uninterrupted, or error-free;
Errors or inaccuracies will be corrected; or
Any particular results or outcomes will be achieved.
The Instructor expressly disclaims any responsibility for the actions or inactions of Users who apply the Content.
13. NO DUTY TO UPDATE
The Instructor has no obligation to update or revise the Content to reflect new scientific or medical developments. Information may become outdated over time.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Instructor shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages— including but not limited to personal injury, death, loss of income, data, or goodwill—arising from the use or inability to use the Content, even if advised of the possibility of such damages.
The Instructor will not be responsible for any direct, indirect, special, incidental or consequential damages whatsoever and howsoever caused, arising out of or in connection with the use or, the inability to use, or from any errors or omissions contained in, the Content, Operation Human First platform or in reliance on the information provided to the User, including any injury, death, property damage, loss of income, forgone opportunities, even if the Instructor has been advised of the possibility of such damages.
15. INDEMNITY
The User agrees to defend, indemnify, and hold harmless the Instructor and her affiliates, officers, employees, and agents from any claim, demand, loss, or expense (including legal fees) arising out of Your use of the Content or violation of these Terms.
16. AUTHORIZATION AND ACCESS
The User must protect all login credentials and ensure that only the User accesses their account.
If the User suspects unauthorized access, the User must promptly notify the Instructor and secure Your account.
The User is responsible for all activities conducted under the User's credentials.
17. SUBSCRIPTIONS, PAYMENT, RECEIPTS & CANCELLATION
Subscriptions and payments for any products are non-refundable. Payments will not be reimbursed or refunded. Pro-rated refunds, refunds for partial months of service, or refunds for months unused with an open account will not be offered. There are no exceptions.
The “Unlimited Subscription”, “Base Subscription”, and 'Sample Subscription" are billed on a Subscription basis ("Subscription(s)"). The User will be billed on a recurring basis ("Billing Cycle"). Billing Cycles are set on a monthly basis. At the end of each Billing Cycle, the User’s Subscription will automatically renew under the exact same conditions until the User terminates their Subscription, either through the “Billing” section of your online “My Account” page or by contacting Alex Murphy. If the User joined the subscription any day following June 1, 2021 the User will cancel the Subscription in their Account Settings by logging in, clicking on “My Account” under the User’s name in the top right-hand corner, selecting “Billing”, and then selecting “Cancel”. When the Subscription is terminated by the User via the Account Settings, the Billing Cycle and access to the Content will be terminated immediately. It is the sole responsibility of the User to cancel their Subscription before the end of their Billing Cycle if the User wishes to avoid being billed. The date that the User’s Billing Cycle renews is also located on the “Billing” page. If the User joined the Subscription prior to June 1, 2021 the User will cancel their Subscription by contacting Alex Murphy via email. Termination via email takes effect within 1-10 business days after the User’s termination request is received by Alex Murphy. It is the User’s responsibility to ensure the request made to Alex Murphy to cancel the Subscription occurs 10 business days before the end of the Billing Cycle or the day that the User’s credit card is charged each month which can also be located by looking at your credit card statements.
A valid credit card is required to process the payment for all Subscriptions. All payments are processed through a third party, Stripe Inc. (“Stripe”). Upon initiating the subscription, the User must provide Stripe with accurate and complete billing information including full name, e-mail, country of origin, state/province, a valid payment method information. By submitting this payment information, the User automatically authorizes Operation Human First and Stripe to charge all Subscription fees incurred through your account to any such payment instruments. If automatic billing fails to occur for any reason, Operation Human First or Stripe will send an electronic invoice to your email indicating that payment must be collected manually by a set due date.
The User agrees to pay all fees and charges incurred in connection with the User's Subscription (including any applicable taxes) at the rates in effect when the charges are incurred. The User must pay all amounts due upon notice of the amounts due. In the event we have to collect unpaid amounts owing, the User will be liable for all legal and collection agency fees.
You’ll receive an email receipt when you sign up for a subscription. Renewal receipts are not automatically emailed each billing cycle, but you can request a copy of any past receipt at any time.”
18. FREE TRIALS
Operation Human First may offer a free trial period. The day that the User initiates the free trial period is “Day 1” of the free trial. Operation Human First does not offer multiple free trails to the same User. Once the free trial period is over the Billing Cycle begins immediately and will continue to be billed on a monthly basis. It is the sole responsibility of the User to cancel their free trial before the Billing Cycle begins. The date that the Billing Cycle is set to begin can be viewed in the User’s Dashboard by” clicking the User’s name in the top right-hand corner, clicking on “Billing”. All Subscriptions are non-refundable. No refunds will be issued.
19. CONFIDENTIALITY AND DATA SECURITY
The Internet is not a fully secure medium. The Instructor is not responsible for interception or alteration of transmissions or unauthorized access to the User's information during communication or payment processing.
Personal information is handled in accordance with OHF’s Privacy Policy.
20. COMPLIANCE WITH LAW
The User agrees to comply with all applicable local, provincial, federal, and international laws in connection with the User's use of the Content.
21. GOVERNING LAW & JURISDICTION
These Terms are governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein.
Any dispute shall be brought exclusively before the courts of Saskatchewan, Canada.
22. ENUREMENT
These Terms of Use bind and benefit the Instructor, the User, and their respective successors, affiliates, and assigns.
23. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the User and the Instructor with respect to the Content and supersede all prior communications or understandings.
BY USING OR ACCESSING ANY OPERATION HUMAN FIRST CONTENT OR PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THE CONTENT.
